The DeKalb County Grand Jury met last Monday, November 14, where 23 people were indicted for various crimes, including a man who allegedly killed his girlfriend with a hammer, and a Liberty man charged with rape of a child.
Simon Rodriguez Martinez, 35, was indicted on first degree murder charges for a crime that took place on September 21.
Smithville Police said they received a call reporting a physical domestic at a home at 620 South Mountain Street. Once officers arrived at the home, they discovered the female victim, 39-year-old Yuri Guerra, with obvious physical trauma. She was pronounced dead at the scene.
Three children were present at the scene, ages 14, five, and five months, all of which were removed and taken into the custody of the Department of Children’s Services. Martinez’s stepdaughter stated during an interview that she witnessed Martinez hit her mother in the head several times with a hammer.
Martinez, allegedly admitted to attempting to clean up blood from the scene and to taking a shower before police arrived. Martinez also allegedly admitted to moving the hammer used in the killing, and throwing the clothes he had been wearing in the trash. Police say that Martinez also confessed to hitting Guerra with the hammer after an argument between the two.
The Grand Jury also handed down an indictment on 64-year-old Carlos Restrepo of Cook Road, Liberty, on two counts of rape of a child. Restrepo had been indicted last year on the charges, but he was re-indicted with a new charge added.
According to the indictment, Restrepo did unlawfully and intentionally or knowingly sexually penetrate a person less than 13 years of age, back on September 10, 2010. The indictment also alleges that between the dates of September 10, 2009, and September 10, 2010, he intentionally or knowingly sexually penetrate a person less than 13 years of age.
Through a press release from the DeKalb County Sheriff’s Department, authorities say that Restrepo was charged in the case for the rape of six year old victim. Although the case is from 2010, the victim did not disclose the crime until March 2021 after they had turned 16 years old.
Authorities say that Restrepo did admit to digitally penetrating the victim's vagina. This case was investigated by the DeKalb County Sheriff's Office and the 13th Judicial District Attorney's General Office.

Angela Lynn Ayers forpossession with intent to sell or deliver a schedule II (methamphetamine) over 0.5 grams.
Aubrey Glenn Rigsby for evading arrest.
Brandon Matthew Lee for aggravated assault (2 counts).
Mark Enik Childs for driving under the influence.
Jonathan Lee Pedigo for child abuse (2 counts).
Daniel Derrick Hill for violation of an order of protection (3 counts).
Molly Sue Lawrence for theft of services over $1,000.
Christopher Joe Bogle for theft of services over $2,500.
Deviyon Quawnyah Johnson-Griffin for forgery, theft of property over $1,000, and criminal simulation.
David Brian Martin for possession with intent to sell or deliver a schedule VI drug (marijuana)
Haley Jada Sosa for driving under the influence and possession of drug paraphernalia.
Lacy Lee West for driving under the influence (4th offense), DUI per se, driving on a revoked license (2nd offense), and violation of an order of protection.
Casandra Kay George for filing a false report.
Markus Anthony Williams for domestic assault.
Candice Denise Walker for driving under the influence.
Tyler Blake Hollingsworth for possession with intent to sell or deliver a schedule I (Fluorofentanyl) and possession of drug paraphernalia.
Cassidy Renee Judkins for theft of property-shoplifting.
Steven Blake Goad for driving under the influence (3rd offense) and possession of a prohibited weapon.
Jackie Marie Ray for driving under the influence.
Melisha Renea Martin for possession with intent to sell or deliver a schedule I (Papa-Fluorofentanyl), and possession with intent to sell or deliver a schedule II drug (methamphetamine).
Tabatha Marie Batey for fraudulent use of a Credit or Debit Card over $1,000.
One sealed indictment was also issued. All of those indicted will appear for arraignment in DeKalb County Criminal Court on December 6.
