Smithville Police have had a busy couple of weeks, making several arrests including one for sexual battery and aggravated assault.
On Friday, November 4, 28-year-old Devin Austin Duke of Alexander Street was arrested for Sexual Battery and Aggravated Assault. According to Smithville Police, officers responded to South Mountain Street for a welfare check on a female reportedly laying on the side of the road.
Upon arrival, the victim was found unresponsive and partially nude, with scrapes and cuts on the right side of her head. Upon investigation, police allege that Duke did sexually assault the victim in his vehicle and then pushed her body out of his vehicle onto the side of the road, wearing only a shirt and sweater, once he realized she had went unconscious from an apparent overdose.
Duke is under a $50,000 bond and is due in court on November 17.
On October 21, 39-year-old Robin Lynne Emigh of McMinnville was arrested for Public Intoxication. Police responded to Sunneco Gas Station where Emigh was allegedly causing a scene. Upon speaking with her, police say she implied she was too high. She was reportedly foaming out the mouth and knocking on other civilians’ windows, causing a bigger scene.
Emigh was placed in custody due to being an endangerment to herself and/or other people. She is under a $1,500 bond and due in court on November 10.
The following day, 31-year-ol William Eugene Sizemore of Adcock Cemetery Road was arrested for Pubic Intoxication. Police were called to Sunneco Gas Station in reference to an altercation, discovered to be verbal only.
The male subject, identified as Sizemore, had left in a white F-150. The officer later made contact with Sizemore at Potter’s Home Center. Sizemore was allegedly drinking a shot of 99 proof strawberry liquor. Upon investigation, police say it was discovered that he had drank three bottles. Sizemore’s speech was slurred and he smelled of an alcoholic beverage.
Sizemore is under a $1,500 bond and due in court on November 10.
On October 24, 48-year-old Jimmy Mason Page was cited for Criminal Littering. Police say that Page was taking items from the bed of his truck and placing them on the ground behind the County Complex. He had previously been told to put the items in the trash but didn’t comply. He is due in court on November 10.
The following day, 43-year-old Dwayne Allen Reeder of Sparta was arrested for Domestic Assault. Police responded to Broadway Market and made contact with Reeder and the victim who appeared to have been arguing.
Upon investigation, police allege that Reeder did knowingly, willingly, and unlawfully, commit the offense of Domestic Assault when he struck the victim in the head and face, resulting in the victim having marks on her and visible blood on her nose and shirt.
Reeder is under a $10,000 bond and is due in court on November 10.
On November 4, 53-year-old Fermin Mata Gopar, of Old Bildad Road was arrested for DUI 2nd, Driving on Revoked 3rd, and Implied Consent. Police conducted a traffic stop for failure to maintain lane of travel and noticed a strong odor of alcohol coming from Gopar's person. He was asked and agreed to sobriety task. On the second task, Gopar did half of the task then refused to do any more.
A check of Gopar’s license was conducted which it came back revoked, and had two prior charges of driving on revoked. He also allegedly refused the implied consent law and a warrant was issued for a blood draw.
Gopar is under a $5,000 and is set to appear in court on November 24.
