A man convicted of possession with intent to sell or deliver methamphetamine was sentenced last week in DeKalb Criminal Court.
In December 2021, Brandon Tylor Mulac, 30, and Logan Nicole Sullivan were indicted by the Grand Jury and charged with possession with intent to sell/deliver a schedule II drug, (meth) over 300 grams, and possession with intent to sell/deliver a schedule II drug (Fentanyl). Mulac was also indicted for possession with intent to sell of deliver over 26 grams of a schedule II drug, (meth) and evading arrest.
A jury trial ended last May with the conviction of Mulac for possession of a schedule II controlled substance in an amount of 300 grams or more. He was also fined $75,000. The jury found Mulac not guilty on a second charge of fentanyl possession with intent to sell or deliver.
The indictment stemmed from an April 2021 investigation after Mulac was found with drugs during a traffic stop in Smith County. Authorities there found out that Mulac had more drugs located at a residence in Smithville, and contacted the DeKalb County Sheriff’s Department to investigate. Sullivan was also charged with the same offenses as Mulac, but she is now deceased.
“We received information from the Smith County Sheriff’s Department that they had found Mulac in possession of a large amount of methamphetamine during a traffic stop there,” said Assistant District Attorney General Greg Strong. “Through that investigation we learned that a large amount of methamphetamine could be found in a house here on South Mountain Street, where we believe Mulac had been staying. We obtained a search warrant based on that information and did find a large amount of methamphetamine at that residence.”
Mulac received a sentence of 60 years as a career offender to serve at least 60 percent of the term before he is eligible for parole. Mulac, who is incarcerated, is expected to seek a motion for a new trial.
