As expected, the case against County Clerk James Lee (Jimmy) Poss was dismissed last week after the complainant in the case dropped the charges. Poss and his once accuser, Cameron Lester, made an appearance in General Sessions Court last Thursday.
The incident occurred on October 4, at 2211 Bright Hill Road, at the home of Poss’ father, where Poss and Lester had an altercation.
In court, the attorney for Poss, Jon Slager, asked Judge Brandon Cox for a dismissal of the charge adding that Lester also wanted the case dropped. Lester was in court as well, and Judge Cox asked Lester to confirm that he wanted to voluntarily dismiss his complaint. Lester indicated yes.
Judge Cox then dismissed the case, stating that if it had moved forward that he would have to recuse himself from the proceedings because Poss and himself were both county officials.
Judge Cox signed an order dismissing the charge, as well as an expungement order under which all public records relating to the offense will be expunged and destroyed upon payment of all costs to the clerk and that no evidence of such records pertaining to the offense be retained by any municipal, county, or state agency, except non-public confidential information retained in accordance with TCA (State Law).
The criminal summons against Poss has now officially been dismissed. The charge had nothing to do with his duties as county clerk.
