NOTICE OF TRUSTEE'S SALE

 

 

 

WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated December 8, 2009, and the Deed of Trust of even date securing the same, recorded December 9, 2009, at Book 311, Page 306 and modified on March 7, 2013, at Book 354, Page 927 in Office of the Register of Deeds for DeKalb County, Tennessee, executed by Stacey Smith-Hale, conveying certain property therein described to Ryan Trammel as Trustee for Mortgage Electronic Registration Systems, Inc, as nominee for First Community Mortgage, Inc., its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee.

 

 

 

NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee will, on July 24, 2014 on or about 10:00 A.M., at the DeKalb County Courthouse, Smithville, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. Hall; thence with Hall's line along an old fence; thence South 7 degrees 02 minutes 04 seconds West 25.00 feet to an old iron pin; thence South 6 degrees 03 minutes 46 seconds West 79.07 feet to an old iron pin located on the Northeast corner of the property of James Clyde Vanatta; thence with Vanatta's line, a fence, South 76 degrees 13 minutes 12 seconds West 24.26 feet to a new iron pin; thence South 74 degrees 00 minutes 01 seconds West 59.03 feet to a new iron pin, thence South 69 degrees 11 minutes 22 seconds West 44.12 feet to a new iron pin; thence South 69 degrees 11 minutes 22 seconds West 47.80 feet to a new iron pin; thence South 69 degrees 10 minutes 31 seconds West 34.77 feet to a new iron pin; thence South 68 degrees 07 minutes 21 seconds West 117.50 feet to the point of beginning, containing 0.70 acres, more or less.

 

Further being Lot 4 on the plan of Boundary Survey for Bobby Simpson and Bart Griffin of record on Plat Book 1, Page 270, Register's Office for DeKalb County, Tennessee, which amended the prior plat of record in Map Slide 1-221D, said Register's Office. Said Lot 4 contains a portion of the former Lot 2 as depicted on said plat of record at Map Slide 1-221D, said Registers Office.
