Bain jailed after domestic disturbance, waving pistol

The sheriff’s department arrested a 24-year-old local man after he allegedly waved a muzzle-loader pistol at them when they arrived to investigate a domestic disturbance.

Clay Andrew Bain has been charged with domestic assault, resisting arrest, aggravated assault, evading arrest, child abuse or neglect, and reckless endangerment. According to Sheriff Patrick Ray, deputy was dispatched to a Lakeview Drive home on Nov. 10 to check out reports of a domestic disturbance.

Upon arrival, Ray said the officer spoke with Bain’s girlfriend, who reported that after she and Bain had gotten into an argument and he shoved her to the ground, causing a cut and swelling to her hand. When the woman’s daughter, a minor, tried to intervene, Bain allegedly grabbed her by the arm and threw her aside, causing injury to the child’s arm and shoulder.

After being told by the deputy that he was under arrest, Bain reportedly ran into the house and went into a back bedroom, where he allegedly picked up a muzzleloader pistol from a dresser and waved it around with the officer and others in the room.

After he was forcibly restrained and handcuffed, the weapon was found not to be loaded.

Bain’s bond totals $22,500 and he will appear in court on Dec. 17.

Meanwhile, Donald Richard Atnip, Jr., 30 has been charged with aggravated burglary and theft of property under $500.

The sheriff said that Atnip broke into a residence on Page Drive on Nov. 1 and took a flat screen Visio television valued at $300. He allegedly admitted to entering the home and taking the TV. The case was investigated by a sheriff’s department detective.

His bond was set at $25,000 and he will appear in court on Dec. 17.

Two men are in trouble with the law for possession of marijuana after their pickup truck got stuck in a field last week.

Donnie Dewayne Frazier, 43, of Dowelltown was charged with possession of a Schedule VI drug for resale, and Eric James Cox, 30, of Woodbury was cited for criminal trespass, simple possession of drugs, and simple possession of drug paraphernalia after police found them in a pickup stuck in a field.

The sheriff said a deputy was dispatched to Game Ridge Road on Nov. 10 to meet a man who reported that he has a field leased for crops, and that a pickup truck was stuck in the field. The men reportedly appeared to have been illegally hunting, and that did not have permission to be on the property.

Ray said the officer found Frazier and Cox to be the occupants of the truck, and obtained consent to search. He reportedly found two firearms and a black bag containing five individual bags and a Mason jar containing a green, leafy substance believed to be marijuana.

Frazier also produced another bag of the same substance, and allegedly told the deputy that the containers and all their contents belonged to him.

A search of Cox’s person allegedly revealed another baggie containing a green, leafy substance believed to be marijuana, along with a pipe containing marijuana residue.

Bond for Frazier was set at $7,500, and both men will appear in court on Dec. 17.

Michael Patrick Layton, 51, of Smithville has charged with being a fugitive from justice. Ray said Layton has a warrant against him from Lee County, Florida for two counts of possession of a controlled substance for resale (Heroin) and two counts of possession of a controlled substance (Heroin).

His bond was set at $50,000, and he is awaiting extradition to Florida.

Cayden Katerina Cantrell, 22, of Dowelltown was charged with assault and domestic assault on Nov. 10.

Ray said a deputy responded to a residence on North Mill Street in reference to an assault. Upon arrival the officer spoke with a man who reported that Cantrell became angry and pepper sprayed him in the face as he tried to break up a fight between the woman and her sister.

The domestic assault charge came when the arresting officer spoke to Cantrell’s sister, who reported that Cantrell grabbed her by the arm and hit her in the face several times.

Her bond was set at $4,000 and she will appear in court on Dec. 10.

Elijah Caleb Poss, 20, was cited for driving on a suspended license and a violation of the light law on Nov. 14. The sheriff said a deputy stopped Poss’ vehicle for a non-working brake light, and a computer check revealed that his license was suspended for failure to appear in December 2013.

He will appear in court on Dec. 2.

Joshua Grissom, 26, was charged with violation of an order of protection on Nov. 11.

Ray said a deputy was dispatched to an Old Blue Springs Road home concerning an unwanted guest. Upon arrival, the officer spoke with Grissom, who was sitting in the driveway of a woman who has an active order of protection against him in a white utility truck, demanding to see his child.

His bond was set at $2,500, and he will appear in court on Nov. 19.

Gary C. Boatwright, 44, of Elmwood was charged with evading arrest and a fourth offense of driving on a revoked license on Nov. 7.

The sheriff said a deputy attempted to stop Boatwright’s vehicle on Highway 70 west for failing to maintain his lane of travel, but the man pulled to the shoulder of the road, then took off again.

The officer began a pursuit which took them to Highway 96, and the pursuit was terminated at the Cannon County line. An investigation revealed that Boatwright was the driver, and a check of his license revealed that it was revoked for a DUI.

Boatwright’s bond totals $13,500, and he appear in court on Nov. 12.
