Brothers James and Dustin Utley, 20 and 18, were arrested on for domestic assault on April 16.
Smithville police responded to a fight between two men in the parking lot at McDonalds, and made contact with the Utley brothers. Upon speaking with the brothers and a motorist that had witnessed the altercation police said it couldn't be determined who initiated the incident, and both parties were arrested for the reasonable likelihood that the offense would keep occurring and for the safety of the two parties.
Both men are under a $1,500 bond, and they will appear in court on May 4.
Meanwhile, Abigail Diane Judkins, 24, was arrested on April for theft, disorderly conduct, and resisting arrest.
Police responded to Wal-Mart in reference to a shoplifter. The officer was reportedly informed that the lady in question was outside in the parking lot. The officer made contact with Judkins and attempted to talk to her, but she was on the phone and wouldn't communicate with him. Judkins was agitated and the officer had to ask her to move out of the way on a couple of occasions as owners were trying to enter or exit their vehicle.
Police said Judkins began yelling and would not cooperate. She denied having any items that belonged to Wal-Mart and became loud and verbally defiant. At one point, Judkins dropped her purse and the officer bent over to pick it up and she grabbed the purse and began to fight with the officer.
With the help of another officer on the scene they were able to restrain Judkins, but she was able to kick one of the officers in the leg a couple of times before being cuffed. Judkins continued to be unruly until they got her into the back of a patrol car, where she began kicking the windows of the car but quit before causing damage. Items taken from Wal-Mart were located along the path that she walked in the parking lot and returned to the store.
Her bond was set at $5,000, and she will appear in court on May 4.
Joseph Michael Brew, 30, was arrested on April 2 for DUI and possession of handgun while under the influence. He was also cited for speeding, financial responsibility, and implied consent.
Police performed a routine traffic stop on a vehicle for a speeding violation. The officer made contact with Brew, who allegedly had an odor of an alcoholic beverage on his person and red watery eyes.
Brew con sented to field sobriety tasks, which he reportedly performed poorly. The officer was informed by Brew that he had a handgun in the vehicle, and the officer recovered a .45 caliber handgun from the floor board.
His bond is $3,000, and he will appear in court on April 27.
David E Driver, 45, was arrested on April 4 and charged as a habitual offender and evading arrest.
On April 2 police responded to a domestic that was determined to be verbal only, but while enroute, the officer was informed by Central Dispatch that the male subject was leaving the scene in a white Ford Ranger with a brown recliner in the bed of the truck. The officer made contact with the vehicle on South Congress and initiated his emergency lights and sirens.
The truck reportedly did not stop, and the officer pursued the vehicle approximately three miles before terminating the pursuit because of traffic conditions. The driver was later identified as David Driver and it was discovered that his license was revoked due to driving after convicted of being a habitual offender. He was later taken into custody without incident.
His bond is $12,000, and appeared in court on April 13.
Shawn L Allen Jr, 22, was arrested and charged with being a fugitive from justice on April 6.
Police initiated a routine traffic stop on a vehicle that matched the description of a vehicle involved in a theft case that was under investigation. Upon making contact with the vehicle, the officer checked the identities of the occupants, and the passenger was found to be Allen, who had a hit confirmation on NCIC out of Ohio for felony possession of drugs and burglary. Allen was arrested and held for extradition back to Ohio.
His bond was set at $75,000.
Tyler Aarone Duncan, 22, was arrested for DUI and cited for speeding and implied consent on April 2.
Police performed a routine traffic stop on a vehicle for a speeding violation. Upon making contact with the driver, who was identified as Duncan, police observed him to have slurred speech, red watery blood shot eyes, and the odor of alcohol coming from his breathe. Duncan consented to sobriety tasks, which he reportedly performed poorly, and refused blood sample.
His bond was set at $1,500, and hen will appear in court on April 27.
Joshua L McCowan, 31, was arrested for public intoxication on April 2.
Police responded to Wal-Mart for a suspicious male subject who appeared to be intoxicated. The officer made contact with McCowan, who reportedly had blood shot, watery eyes, slurred speech, and was unsteady on his feet.
McCowan was asked to step outside and to perform field sobriety tasks, which he performed poorly on. Believing him to be a danger to himself and the public, the officer took McCowan into custody.
His bond is $3,000, and he will appear in court on April 27.
Garrett Michael Johnson, 23, was arrested for DUI and cited for simple possession, implied consent, financial responsibility, and stopping, standing, parking in roadway on April 14.
Police responded to the area of Braswell Lane for a vehicle in the middle of the road. Johnson allegedly informed the officer he was out of gas. Johnson reportedly had small pupils, slurred speech, and was unsteady on his feet.
Johnson reportedly performed poorly on standardized field sobriety tasks, and a search revealed a pill bottle without a label containing 9.5 pills in the center console of the vehicle. Johnson said he had a valid prescription for the medication, but couldn't provide one at the time.
His bond was set at $1,500, and he will appear in court on May 4.
Tracy Ann Thomason, 31, was arrested on April 14 for DUI.
Police reportedly observed a silver car swerve over the yellow and white lines on East Broad Street. Tracy Thomason was found to be the driver, and allegedly suffered from slow and slurred speech. Police said Thomason agreed to perform field sobriety tasks and performed poorly. Thomason was deemed to be intoxicated and arrested for her and the public's safety.
Her bond is $1,500, and she will appear in court on April 27.
Robert Edward White, 47, was arrested for DUI on April 16.
White was allegedly found passed out behind the wheel of his vehicle with his foot on the brake and the vehicle still in drive in McDonalds drive thru. After multiple attempts, White finally responded, and the officer observed him to have slurred speech and pupils dilated.
White was asked and consented to HGN test to which he performed poorly. He did submit to blood test then taken into custody without incident.
His bond is $2,500, and he will appear in court on May 4.
Terry Junior Reeder, 36, was arrested for DUI and cited for simple possession and implied consent on April 1.
City police said officers conducted a welfare check on a person sitting in a vehicle in the parking lot of Hardees after hours. After multiple attempts to awaken the male subject, he woke and was identified as Reeder.
He allegedly had blood shot watery eyes and slurred speech. Reeder reportedly consented to field sobriety tasks, upon which he performed poorly. Police said a search of his vehicle revealed two small rolled papers with a green leafy substance believed to be marijuana.
His bond is $1,500, and he will appear in court on April 27.
Deia Marie McCormick, 34, was arrested for DUI and cited for driver's license violation and implied consent on April 13.
Police were dispatched to the area of South Congress due to a possible intoxicated driver. The officer made contact with the driver of the vehicle described and identified her as Deia McCormick.
McCormick allegedly had slurred speech and was unable to keep her eyes open. She consented to field sobriety tasks, which she performed poorly on. It was discovered through Central Dispatch that her license was suspended and she decline consent for blood test.
Her bond is $1,500, and she will appear in court on May 4.
Roger Tremain Rapp III, 50, was arrested on April 1 for his third offense of driving while his license was revoked.
Police responded to an area on Bright Hill Road due to a BOLO for a small black car that was involved in a hit and run accident in Warren County. Police were able to make contact with the vehicle just inside the city limits. The driver of the vehicle was identified as Rapp, and upon checking his license for validation, it came back as being revoked.
His bond is $4,500, and he will appear in court on April 27.
Cynthia Ann Clevenger, 48, was arrested for her fourth offense of driving on a revoked license and cited for speeding on April 11.
Clevenger was stopped for a speeding violation and she was found to have a revoked driver's license. A check reportedly revealed that her license was suspended in 2011 for accumulation of points.
Her bond is $3,000, and she will appear in court on May 4.
Sharlett Ann Carioscia, 55, was cited for assault on April 13.
Police said the victim was visiting a neighbor when Carioscia assaulted her by kicking her in the leg. She will appear in court on April 27.
Joshua Lynn McCowan, 28, was cited for fraudulent use of a credit card on April 17.
McCowan allegedly used a card that was stolen from a victim's vehicle on March 30. The card was used at Wal-Mart on three different occasions on the date of the theft.
He will appear in court on May 4.
