Couple arrested for child abuse

Donnie Ray Gillman, 35, and Christina Dawn Mooneyham, 39, were arrested on Dec. 1 for child abuse and neglect. 

 

Smithville police said they took a report from a Department of Children’s Services case worker on Nov. 28 who stated she had received a referral alleging Donnie Gillman and Christina Mooneyham were abusing methamphetamine.  DCS began an investigation into the allegation. 

 

Both Gillman and Mooneyham allegedly tested positive for methamphetamine on a urine drug screen for DCS on Nov. 8, and admitted to using in the home while caring for their child.  DCS reportedly completed a hair follicle test on the 25-month-old child, which returned positive for methamphetamine.  The child was placed in a foster home on Nov. 9.

 

Bond was set at $5000 each, and the pair will appear in court on Dec. 15.

 

Aubrey Glenn Rigsby, 37, was arrested for aggravated assault with a deadly weapon and carrying or possession of weapon on Dec. 7. 

 

Police responded to Wal-Mart in reference to a person armed with a gun.  Upon making contact with the suspect, who was found to be Rigsby, he was ordered to put his hands in the air and step out of the car. 

 

According to police, one of the officers observed Rigsby start to exit the vehicle in a forceful manner while reaching toward his waistline and appeared to be grabbing something at which time the officer shouted “he’s reaching” to the assisting officer. The policeman began to wrestle with Rigsby, and saw that he was gripping a gun.

 

The officer was able to keep Rigsby from drawing the weapon from a holster in the front of his pants.  Rigsby stopped resisting and raised his hands in the air, at which time the officer removed a loaded handgun from him.  A certified criminal history check revealed that Rigsby is a convicted felon. 

 

His bond was set at $60,000, and he will appear in court on Dec. 22.

 

Orlando Rivera Febus, 58, was arrested on Dec. 7 for aggravated assault. 

 

According to the victim, Febus accused him of being on his property and in his truck the night before.  After the victim denied the allegations, Febus reportedly struck the victim in the head with a hammer.  The victim defended himself and the two fought. 

 

Based on accounts from witnesses and the injuries obtained by the victim it was determined that Febus was the primary aggressor, and warrants were granted for his arrest.  Febus was taken into custody later in the day. 

 

His bond was set at $5000, and he will appear in court on Dec. 22.

 

Brandon Lee Starnes, 40, was arrested and charged with possession of Schedule II drug w/intent to resell, carrying or possession of a weapon on Dec. 2. He was also cited for simple possession, drug paraphernalia, dl violation, registration violation, and violation of the financial responsibility law. 

 

Police were called to a person passed out at the wheel of a vehicle.  Upon the officer approaching the vehicle, the lawman was allegedly able to see a bag of pills lying in the passenger seat in plain view. 

 

As the driver door was opened and Starnes stood and exited the car, police saw a handgun between the driver seat and console, at which time Starnes was placed into custody. Starnes reportedly granted consent to search the vehicle, and two black bags and two scales were located in the center console.

 

Police said that one bag contained smaller bags with a white powdery substance, two smaller bags with a clear crystal substance, and several empty plastic bags.  The substances found are believed to be approximately 1.5 ounces of methamphetamine. 

 

A total of twelve pills were recovered as well, with two believed to be 30mg morphine and ten believed to be 10mg Oxymorphone. Police report that twelve hypodermic needles were also found in the vehicle.  Starnes is also a convicted felon in possession of a weapon. 

 

His bond was set at $20,000, and he will appear in court on Dec. 22. A 2001 Chevrolet Monte Carlo and cash is in the process of being seized as well.

 

Bennie L Simmons, 38, was arrested early on the morning of Dec. 6 and charged with aggravated assault and evading arrest. 

 

Police responded to a residence for a 911 hang up, and when the officer arrived a woman reportedly informed him that a man was inside her house with a knife.  The officer attempted to make contact with the subject as he was running out the back door. 

 

Police said the officer advised the subject multiple times that he was the police, and to stop running.  The officer was able to take the subject into custody at the intersection of Hayes and Gentry Streets, and was identified as Bennie Simmons. 

 

An investigation reportedly determined that Simmons had grabbed a knife out of a kitchen drawer and began to kick around furniture, holding the knife in his hand while threatening the victim. 

 

His bond was set at $15,000, and he will appear in court on Dec. 22.

 

Robert Alan Norrod, 20, was cited for criminal impersonation on Dec. 5. 

 

Police responded to a call at Wal-Mart, and upon questioning Norrod, he gave the officer his brother's name.  Upon learning this information, Norrod was cited to be in General Sessions court on Dec. 15.

 

Benito Saldivar Narvaez, 56, was arrested for DUI on Dec. 6.

 

Police dispatched to the area of South College Street and Vaughn Lane in reference to a gray Ford truck sitting in the middle of the road for approximately 15 to 20 minutes made contact with the truck and observed a male subject slumped over the wheel. The truck was allegedly running with the transmission in drive. 

 

Upon waking the driver, who was identified as Narvaez, he was found to have a smell of a fermented beverage about his person, red glossy eyes, and was unsteady on his feet upon exiting the truck.  Narvaez was then asked to submit to several field sobriety tasks in which he performed poorly.

 

His bond was set at $ 15,000, and he will appear in court on Dec. 22.
