For the second time in three days, Smithville police officers found a DeKalb County woman in violation of a restraining order while on probation, making it a third strike for the woman as police placed her in custody yet again.

On Sunday, Aug. 20, Smithville police responding to a possible overdose call, arrested 48-year-old Lou Ann Sanders for a third offense of violation of an order of protection after first making contact with Jason Allen Bates, 41, of Smithville who has an active order of protection against Sanders. Sanders was found sitting in a chair beside Bates and was taken into custody without incident.

It wasn’t the first time police had the met the pair, having responded to a call concerning two subjects walking in the middle of the road on Anthony Avenue Thursday, Aug. 17. Officers found Bates and Sanders in the Wal-Mart parking lot and upon speaking to the couple, the officer observed Bates to have slurred speech, was unsteady on his feet and had to hold Bates up to keep him from falling to the ground.

Bates was placed into custody for public intoxication due to the likelihood he would endanger himself or another. A computer check also revealed that Bates has an active order of protection against Sanders, at which time she was taken into custody for violating the order of protection and cited for simple possession as a search incident to arrest, the officer found a prescription bottle filled with Alprazolam belonging to Bates in her pocket.  Bond for Bates was set at $1,500 while bond for Sanders was $2,500. Arraignment date for both will be Sept. 14.

Bond for Sanders was set at $5,000.00 with arraignment Sept. 14 on her latest arrest.
