Johns sentenced for assault of woman

An Alexandria man accused of assaulting a woman while holding a gun on her entered a plea by criminal information to aggravated assault.

 

Timothy Dewayne Johns, 43, received a six-year sentence all suspended to TDOC probation on judicial diversion. He must pay $400 restitution to the victim, and he is under a restraining order to keep away from her. Johns must also undergo domestic violence counseling.

 

The sheriff said that a deputy responded to a residence on New Hope Road due to a physical domestic involving a gun on May 7 spoke with the victim and learned that Johns had allegedly ripped off most of the woman’s clothing and assaulted her. The deputy observed a knot on her left brow and several scrapes and red marks on her neck, hands, legs, and knees.

 

The woman said Johns held a pistol to her head during the assault and then put the handgun in her mouth, saying he should just kill her. The woman claims Johns tried to choke her several times while inflicting blows about her head and body.

 

Matthew Adam Cubbins, 21, charged in several forgeries was sentenced in DeKalb County Criminal Court last week.

 

Cubbins entered a plea by criminal information to three counts of forgery before Judge David Patterson presided, receiving a sentence of two years in each case, to run consecutively for a total of six years, but suspended to TDOC probation.

 

Cubbins was ordered to pay restitution to Wilson Bank & Trust in the amount of $1,650; to Regions Bank for $950; to Shiney Rock Market for $300; and to Liberty Stop N Buy for $400.

 

According to Sheriff Patrick Ray, Cubbins stole checks from a family member and passed them at Wilson Bank & Trust in Smithville for $300 on May 25; for $200 on May 26; for $300 on June 3; for $300 on June 6; and for $300 on June 7.

 

He reportedly passed checks at Regions Bank in Smithville for $250 on May 27; for $200 on May 31; and for $300 on June 1. He then passed more of the stolen checks at Shiney Rock Market for $200 on May 29 and for $300 on June 7, and at Liberty Stop N Buy twice for $2000 each on June 13.

 

Meanwhile, James Mitchell Johnson, 41, originally charged with four counts of forgery, entered a plea to three counts. He was given a two-year sentence in two of the cases, and one year in the third case, all to run consecutively for a total of five years. The term will run consecutively with a Wilson County sentence against him. Johnson must make restitution of $425 to Wilson Bank & Trust, $21.81 to Liberty State Bank; and $100 to DeKalb Market. He was given 300 days jail credit.

 

Ray said that Johnson passed forged checks on September 11, 2015 at Wilson Bank and Trust in the amount of $300, on September 13 at DeKalb Market in the amount of $100, and at Save-A-Lot for $125; and on September 14 at Walmart for $21.81.

 

Patricia Billings, 45, entered a plea by criminal information to burglary of a motor vehicle and theft under $1,000. She was given a two-year sentence in the burglary case and 11 months, 29 days for the theft, all suspended to TDOC probation. The two terms will concurrently.

 

Billings must pay restitution of $560 to the victim and $183.67 to Discover.

 

Billings reportedly entered the victim’s vehicle on May 20 and took a wallet containing $560 in cash and several credit cards.
