A 19-year-old man was arrested by Smithville police after he allegedly refused to cooperate with officers investigating a domestic situation at Walmart.

Upchurch is accused of disorderly conduct and resisting stop, frisk, halt, arrest or search.  Police said officers responded to Wal-Mart concerning a verbal domestic. Upon arrival, the officer saw a male and female sitting in the grass out front of the Walmart parking lot. The man reportedly stood up and grabbed the infant child and began to walk away.

Police said the officer gave Upchurch verbal commands to stop multiple times, but the man proceeded to walk away with the infant, raising his voice and telling the officer he didn't have to stop and talk to him.  The officer reportedly followed Upchurch inside the store as he was concerned for the child's safety.

Upon exiting the building, backup officers were able to make contact with Upchurch also.  One of the officers grabbed Upchurch's hand, and together the lawmen were reportedly able to get the child out of Upchurch’s arms.

Upchurch then allegedly tensed up, pulled away and resisted being placed into custody.  It was determined that he was the primary aggressor in the verbal domestic, and was engaging in a violent or threatening behavior to the female and the public.
