According to city police, members of the department discovered a man having sex with an underage girl while patrolling during the Jamboree Friday.According to Lieutenant Matt Holmes of the Smithville Police Department, 24-year-old Bryan Cunningham was charged with with statutory rape after officers found him having sex with a 15-year-old girl on a dirt road at the bottom of Town Hill on Holmes Creek Road.Holmes told the Review that he and Sergeant Brad Tatrow were checking the area at the bottom of the hill, a known hangout by Fall Creek on July 5 when the illicit act was revealed.Police said Holmes and Tatrow caught the couple engaged in sexual activity in the woods by the creek.Cunningham was placed under a $5,000 bond and will be in court to answer the charges on July 11.
