Man charged with theft of rebar

The sheriff's department has arrested a 66-year-old Smithville man and charged him with stealing thousands of pounds of rebar from a local nursery on five different occasions and selling it for scrap. James Dallas McMillen, Jr. has been charged with one count of theft under $500, one count theft over $500, and three counts of theft over $1,000.

 

According to Sheriff Patrick Ray, McMillen made two trips from Pirtle's Nursery to a recycler on Aug. 13, taking 360 pounds of the metal bars on the first rip, and 1,140 pounds on the second. He allegedly returned the next day and took two more loads weighing 880 pounds and 1,380 pounds, then took 1,100 more pounds on Aug. 15.

 

His bond totals $19,500, and he will appear in court on Aug. 28.

 

Meanwhile, Orry Joseph Savage was charged with being a fugitive from justice on Aug. 11.

 

Ray said Savage faces theft by deception and persistent felony offender charges in Russell County, Kentucky. His bond was set at $50,000.

 

James Grady Warner, Jr., 50, was charged with aggravated assault on Aug. 15.

 

Ray said Warner assaulted his wife by grabbing her by the throat and he throwing her to the ground, causing a knot on the back of her head. He allegedly hit her in the face as well, resulting in a knot on her forehead.

 

Physical markings could reportedly be seen on the woman's throat. The sheriff said a minor child was in the home at the time, and witnessed the assault. After being placed under arrest, Warner reportedly told his wife "I will be back and you will pay for this".

 

His bond was set at $15,000, and he will appear in court on Aug. 28.

 

David Royden Drennan, 49, was charged with violation of the sex offender law for not registering as required and for not reporting that he had changed jobs.

 

Sheriff Ray said Drennan was supposed to have registered as a sex offender no later than July 6 but that as of August 12, he still had not. The TBI contacted the sheriff's department and requested a warrant be taken out against Drennan.

 

His bond was set at $5,000, and he will appear in court on Aug. 21.

 

Douglas Ray Ferrell, 48, was charged with public intoxication on Aug 15.

 

According to the sheriff, a deputy dispatched to Dale Ridge Road on a domestic assault call found Ferrell in the road shouting. Ray said this was the third time deputies had been called to the same address that day in connection with Ferrell.

 

He reportedly went to a neighbor's house, where he harassed and annoyed them, asking for rides to go get beer. Ferrell allegedly had a strong odor of alcohol and was unsteady on his feet.

 

His bond was set at $1,500, and he will appear in court on Aug. 28.

 

Paul Cox Herron, Jr., 67 is charged with a second DUI offense and for driving on roadways laned for traffic on Aug. 12.

 

The sheriff said a deputy spotted a gray Honda Accord leaving its lane of travel and crossing the white line onto the shoulder of the highway. The officer stopped the vehicle and found Herron behind the wheel.

 

Herron allegedly had a strong odor of alcohol on his person, slurred speech and bloodshot eyes. He reportedly admitted to drinking four beers, and submitted to, but performed poorly on, field sobriety tasks.

 

His bond was set at $3,000, and he will appear in court on Sept. 11.
