Two arrested on sealed indictments

The DeKalb County Sheriff's Department picked up two people last week named in sealed indictments handed down by the grand jury on July 27.

 

Ellissa Sara Howard, 30, arrested on Aug. 8, was indicted on two counts of sale and delivery of a Schedule II drug (Amphetamine). Her bond was set at $60,000.

 

Joel Thomas Hayes of Dowelltown, 37, arrested Aug. 9, was indicted for sale and delivery of a Schedule II drug (Hydromorphone). His bond was set at $30,000.

 

Hayes and Howard appeared in criminal court for arraignment Monday.

 

In other crime news, Lynda Erika Brown of Punta Gorda, Florida, 31, and 28-year-old David Colby Johnson of North Fort Myers, Florida have both been charged with being fugitives from justice. Both had failure to appear warrants against them in Florida for possession of a controlled substance (marijuana) over 20 grams.

 

Bond for both Brown and Johnson was set bat $50,000, and both have been extradited to Florida.

 

Dustin Allen Hale, 25, has been charged for resisting stop, frisk, halt, arrest, or search.

 

Sheriff Patrick Ray said an officer went to Hale's home to pick him up for failure to appear and violation of probation and found Hale hiding in the bathroom. When Hale came out, he was instructed by the deputy to place his hands behind his back, and refused to comply. As he was being placed under arrest, Hale allegedly refused to cooperate with the officer and had to be forcibly taken to the ground.

 

His bond is $1,500 and he will appear in court to answer the resisting stop, frisk, halt, arrest, or search charge on Aug. 13. He will be in court for the failure to appear warrant on Sept. 24. He is being held without bond for failure to appear and violation of probation. He was scheduled for a court appearance Monday on the violation of probation charge.

 

Kimberly Ann Patterson of Dowelltown, 47, was charged with possession of a Schedule II drug (Dilaudid) for resale on Aug. 27.

 

The sheriff said a detective went to Patterson's residence on Toad Road and spoke with her, and while discussing a search, Patterson produced money and a silver container from her bra. The cash totaled $200, and four and a half pills believed to be Dilaudid were found in the container. She was placed under arrest.

 

Her bond was set at $25,000 and she will appear in court on Aug. 27.

 

Stephen James Miller, 23, was cited for simple possession of a Schedule II and VI drug on Aug. 7.

 

Ray said a deputy went to South Mountain Street to serve a civil paper and saw Miller smoking a joint. A search allegedly revealed 1.5 grams of marijuana and .1 gram of cocaine.

 

He will appear in court on Sept. 3.

 

Larry James Pedigo Jr., 39, was charged with driving under the influence and cited for violation of the implied consent law and driving on roadways laned for travel on July 28.

 

Ray said a deputy observed a red Mustang driving 25 mph in a 40 mph zone. The car reportedly crossed into the turning lane multiple times. Upon stopping the vehicle and speaking with the driver, Pedigo, the officer said the man had a difficult time taking out his wallet, and his speech was slurred. Pedigo allegedly performed poorly on field sobriety tasks and refused to submit to a blood alcohol test.

 

His bond was set at $1,500, and he will appear in court on Sept. 24.

 

Christopher James Sherfield, 39, was charged with driving under the influence on Aug. 1.

 

The sheriff said a deputy was dispatched to 186 Page Drive to check out a report of an unresponsive man in a truck. The officer allegedly found Sherfield asleep in the driver's seat with his foot on the brake, the keys in the ignition, and a glass bottle of liquor, a bottle of juice, and some beer at his side.

 

The deputy said he detected a strong odor of alcohol coming from the truck. After waking Sherfield, the officer noticed that his eyes were bloodshot, his speech was slurred, and he was very unsteady on his feet. He performed poorly on field sobriety tasks and he submitted to a blood test.

 

His bond was set at $1,500, and he will appear in court on Sept. 24.

 

James Danny Troglen of Doyle, 49, was charged with driving under the influence and cited for driving on roadways laned for traffic on July 22.

 

Ray said a deputy spotted a white car crossing the center line and white emergency line and made a traffic stop. When he spoke with the driver, Troglen, he found that his speech was slurred.

 

When asked if he had been drinking or taking medication, Troglen allegedly said he had just left the hospital. Troglen said he had been given some medication, including a pill intended to make him sleep. When asked what day it was, Troglen said July 16 when it was actually July 22, and reportedly did not seem to know where he was at the time. He submitted to but performed poorly on field sobriety tasks. He also took a blood test and was placed under arrest.

 

His bond was set at $1,500, and he will appear in court on Sept. 24.

 

Dakota James Taylor of Manchester, 23, was charged with public intoxication on Aug. 7.

 

The sheriff said a deputy was dispatched to Pates Ford Marina after receiving reports of an intoxicated man walking down the roadway. Upon arrival, the officer found Taylor lying on the sidewalk next to the road.

 

He reportedly had a strong odor of alcohol on his person. When he stood up, Taylor was very unsteady on his feet. For his safety and that of others Taylor was placed under arrest for public intoxication.

 

His bond was set at $1,500, and he will appear in court on Aug. 20.

 

Sherry May Evans, 36, was charged with domestic assault on July 12.

 

Ray said a deputy responding to Shady Drive in Smithville due to reports of a domestic assault spoke to a woman who said the she and her sister-in-law, Evans, had gotten into an argument. The woman said when she asked Evans to leave her home, Evans grabbed her gown and punched her in the face causing swelling near her left temple. Evans allegedly admitted to punching the woman.

 

Her bond was set at $2,500, and she will appear in court on Aug. 13.

 

Amanda Marie Hatfield, 23, was charged with domestic assault on Aug. 9.

 

Ray said a deputy responding to a residence on Adcock Cemetery Road to investigate reports of a physical domestic spoke to both Hatfield and a man who told the officer that he and Hatfield had gotten into an argument over a phone and that she grabbed his shorts. When he stepped away from her, she slapped his face.

 

Her bond was set at $2,500, and she will appear in court on Aug. 13.

 

Jonathon Charles Hall, 28, was charged with domestic assault on July 23.

 

The sheriff said a deputy responding to a residence on Magnolia Lane to check out a domestic complaint determined that Hall had assaulted his brother by punching him in the face during a fight. The victim's right eye was swollen from the blow. According to the deputy, Hall got off the couch and went into the kitchen where he got into an argument with his brother which resulted in a fight.

 

His bond was set at $2,500, and he will appear in court on Aug. 27.

 

Rebecca Jade Andrews, 35, was charged with domestic assault on July 30.

 

Ray said a deputy was dispatched to the area of Cookeville Highway after receiving a report that a woman had fallen by the road. Upon arrival, the officer spoke to a man who said that he and Andrews had been in an argument, but that she had left.

 

The man said Andrews was very intoxicated, and had asked him for $250. When he refused to give her money, Andrews became irate. He claims Andrews began calling him names, spat on him, threw a beer can at him, and slapped him in the face. When he pushed her away from him, Andrews ran toward the road where she fell and injured her mouth.

 

He said a man in a red truck stopped and picked her up. She was apparently dropped off at the sheriff's department. The officer came back to the jail and spoke with her there, and she was determined to have been the primary aggressor.

 

Her bond was set at $2,500, and she will appear in court on Aug. 6.

 

Jennifer Nicole Miller, 29, was charged with domestic assault on Aug. 1.

 

The sheriff said a deputy was dispatched to a residence on McMinnville Highway due to a domestic complaint. Upon arrival, the officer spoke with a man and his wife, Miller, who said they had gotten into an argument which escalated into a fight, resulting in the man suffering a bloody nose. The deputy found no marks or injuries to Miller. She was determined to have been the primary aggressor and was placed under arrest.

 

Her bond was set at $2,500, and she will appear in court on Aug. 13.

 

William Andrew Cantrell, 46, was charged with a third offense of driving on a revoked license on July 22.

 

Ray said a deputy saw Cantrell driving a vehicle on Braswell Lane, and knowing that Cantrell's license were revoked, he stopped the car. Cantrell reportedly could not produce a valid driver license, and a computer check confirmed that his license was revoked in September 1992 for DUI. He was previously charged with driving on a revoked twice in September 2005.

 

His bond was set at $5,000, and he will appear in court on Sept. 24

 

Randi Renee Atnip, 27, was charged with failure to appear on June 26.

 

The sheriff said that Atnip failed to report to the jail to serve a 30-day sentence for violation of probation. Her bond was set at $1,500, and she will appear in court on Aug. 20.

 

David Earl Hickman, Jr. of Elmwood, 43, has also been charged with failure to appear.

 

Ray said Hickman failed to report to the DeKalb County Jail to serve a weekend sentence as part of a 30-day term for failure to pay child support on March 28-April 4. His bond was set at $2,500, and he will appear in court on Aug. 13.
