A 27-year-old local woman accused of participating in the 2013 kidnaping and rape of a woman entered a guilty plea to being an accessory to kidnapping before Judge David Patterson in DeKalb County Criminal Court on Sept. 14.
Samantha Devault was indicted with three other people in December 2013 on charges that they had kidnapped and raped a woman, allegedly because they thought she had stolen money and drugs from them.
The four allegedly held the victim against her will at one of the home of one of the defendants in October 2013. Police alleged that the woman stripped and penetrated while being searched for the missing money and drugs, then her clothes were stolen. She was allegedly dropped on the side of the road with very little clothing after the incident.
Devault received a six-year sentence with the Tennessee Department of Corrections, to run concurrently with a Davidson County sentence against her. She was given 344 days credit for time served.
Meanwhile, Thomas Braxton Nix, 20, entered a plea by information to the charge of possession of a Schedule II drug (meth) for resale, and violation of probation in a previous drug case. Nix was given an eight-year jail term on the meth charge, suspended to probation. The term will run consecutively with a two-year sentence for the violation on the previous conviction for possession of a Schedule VI drug for resale.
His probation was revoked and he was given credit for 55 days served. He must, however, serve a 180-day mandatory sentence through the 13th Judicial District Drug Court program.
According to Sheriff Patrick Ray, a sheriff’s department detective made a traffic stop on a red Grand Am on July 20 after observing the car weaving on Highway 70 east. He stopped the vehicle on Terrell Road, and as he approached the car, the lawman saw that the Nix was moving around inside the vehicle as the he approached it.
The officer asked Nix to get out of the vehicle, and when he left the driver’s seat the detective saw a cellophane pack with four alprazolam pills inside. After Nix gave consent for a search of his person, the detective spotted a small piece of "ICE" (methamphetamine) a baggie containing "ICE" was reportedly found on the ground behind the vehicle as well.
Inside of Nix’s wallet the officer allegedly found 17 Hydrocodone pills. During a search of the vehicle, the detective also found a bag containing two Mason jars. One of the jars was full of marijuana, and the other had two marijuana buds.
Two digital scales, several baggies, and a marijuana shredder were also found in the bag. Nix was reportedly in possession of 23.4 grams of meth, 2.66 ounces of marijuana, four Alprazolam pills, and 17 hydrocodone pills along with $853 cash. Nix was arrested and allegedly admitted to selling meth.
James Michael Tatum, 48, pled guilty by information to aggravated burglary and aggravated assault, receiving a four-year sentence, suspended to probation. He was credit for 31 days served.
The sheriff said Tatum broke into a home at Wilson Hollow Road in Liberty on July 31 and pointed a Glock .45 caliber handgun at the homeowner. Tatum reportedly camouflaged his face to hide his identity.
Ellissa Howard, 30, pled guilty to sale of a Schedule II drug (meth) getting a three-year sentence, all suspended to supervised probation. She is requesting Judicial Diversion. Howard was fined $2,000 and given credit for five days served in jail.
Sonny Alan Stults, 24, pled guilty to reckless endangerment, receiving an 11 month, 29 day sentence to be served on supervised probation.
